Terms of Service

MotionAds AI is an online platform that uses artificial intelligence to generate visual content (animated motion graphics and carousels) for social media and advertising campaigns. Access requires registration and payment of a monthly subscription and/or the purchase of one-time credits.

• You must be at least 18 years old to use the Services.
• You must provide accurate information and keep it up to date.
• You are responsible for keeping your login credentials confidential and for all activities carried out through your account.
• Notify us immediately of any unauthorized use of your account.

• Monthly subscriptions are charged automatically to the registered credit card on the monthly anniversary of your subscription.
• Créditos form one balance for creating and editing. The applicable cost is shown before confirmation. Chat edits reserve the approved limit and, when completed, charge the final cost and return the unused difference to your balance.
• Unused credits included in your plan expire at the end of the billing cycle. One-time credits purchased separately do not expire while your subscription is active.
• Cancellation: you can cancel at any time on the Subscription page. Access continues until the end of the paid period. We do not refund partial periods.
• Purchase refunds: under Article 49 of the Brazilian Consumer Protection Code, you may request a refund of the amount paid within 7 days of your first purchase, provided you have not used a significant amount of credits. The refund covers the payment (subscription or credit pack) and is returned through the original payment method. Submit requests by email.
• Used credits: generation deducts credits when it runs, and credits already used are not returned, including when you dislike the result. The platform offers AI editing to adjust an existing creation at a lower cost than generating it again. Exception: if generation fails because of a technical error on our side, the deduction is automatically reversed without a request.
• Payment is processed by Stripe. We do not store card details.
• Price changes: changes to pricing will be communicated by email at least 30 days in advance.

When using the Services, you agree not to:

• Generate content that is illegal, defamatory, fraudulent, discriminatory, violent, sexual involving minors, or infringes third-party rights.
• Use the platform to deceive consumers (false advertising, financial scams, pyramid schemes, misleading offers).
• Attempt to bypass usage, credit, or billing limits.
• Reverse engineer, decompile, or attempt to access the source code.
• Share login credentials with unauthorized third parties.
• Overload the infrastructure or carry out attacks (DoS, mass scraping, etc.).
• Resell, redistribute, or sublicense access to the Services without express authorization.
• Use the platform in violation of any applicable law or regulation.

Violating these terms may result in immediate suspension, account termination without a refund, and applicable civil or criminal liability.

• Content you generate: motion graphics and carousels generated from your prompts belong to you. You are free to use them commercially, provided you comply with these Terms and applicable law.
• Platform: the MotionAds AI software, design, brand, logos, code, AI models, and technology are the exclusive property of us or our licensors.
• Limited license: we grant you a personal, non-exclusive, revocable license to use the platform under these Terms.
• Anonymous use of your data: we may use prompts and results in an aggregated, anonymized form to improve our models and features.

Artificial intelligence models may occasionally produce inaccurate, offensive, or unexpected results. You are responsible for:

• Reviewing all generated content before publishing or running it.
• Ensuring the final content complies with the policies of the platforms where it will appear (Instagram, TikTok, LinkedIn, etc.).
• Verifying usage rights for brands, names, images, and fonts that appear in the result.
• Complying with advertising laws (CONAR, the Brazilian Consumer Protection Code, and laws specific to your industry).

We work to keep the service available, but we do not guarantee 100% uptime. Scheduled maintenance will be announced in advance when possible. Customer support is available at /atendimento.

To the maximum extent permitted by applicable law, MotionAds AI will not be liable for:

• Indirect damages, lost profits, or lost opportunities.
• Failures arising from force majeure, connectivity issues, or unavailability of third-party providers (Stripe, Clerk, Anthropic, Vercel).
• Misuse of generated creatives by you or third parties.
• AI-generated content containing inaccuracies, bias, or inappropriate language — you must review it before publishing.

Our total liability in any event is limited to the amount you actually paid in the 12 months preceding the event giving rise to the claim.

We may suspend or terminate your account, with or without prior notice, in the event of:

• Violation of these Terms or the Privacy Policy.
• Fraudulent, abusive, or illegal use.
• Unpaid subscription fees or unjustified payment chargebacks.
• A request by competent authorities.

You may close your account at any time by contacting our support email. After closure, data may be retained as described in our Privacy Policy .

We may update these Terms periodically. Material changes will be communicated by email and/or an in-platform notice at least 15 days in advance. Continued use of the Services after the changes constitutes acceptance of the new Terms.

The processing of personal data is governed by our Privacy Policy , which forms an integral part of these Terms.

These Terms are governed by the laws of the Federative Republic of Brazil. Disputes shall be heard by the courts in the district where the consumer User resides, in accordance with the Brazilian Consumer Protection Code.
